What is ESHA compliance in construction?
An Environmentally Sensitive Habitat Area (ESHA) is a rare, threatened, or irreplaceable habitat — wetlands, riparian corridors, oak woodlands, vernal pools, and similar ecosystems — that is protected from degradation under California Coastal Act policy and many other environmental regulations. Construction near an ESHA triggers biological monitoring requirements and work restrictions.
How ESHA affects construction projects
- Buffer zones — Work is typically prohibited within 50 to 100 feet of an ESHA boundary, depending on the resource type and the requirements of the project's biological opinion or environmental document. The buffer distance is project-specific.
- Nesting bird season — Active nesting season (typically February through August) restricts vegetation clearing and ground disturbance near potential nesting habitat. A pre-construction nesting survey may be required before work can start in sensitive areas.
- Biological monitoring — A qualified biological monitor may be required on-site during ground disturbance activities near ESHA boundaries. The monitor has authority to stop work if a protected species is encountered.
- Work windows — Certain species have specific work windows. Fish passage seasons restrict in-water work. Raptor nesting seasons restrict vegetation removal. These windows are specified in the project's biological conditions.
Tracking ESHA compliance on a project map
ESHA boundaries and buffer zones can be drawn directly on the project map as polygon overlays. Pins at the boundary mark monitoring locations, biological observations, and any required pre-construction surveys. The field crew sees exactly where the restricted zone begins before they move equipment.
